Welcome to the RoseProxy service (hereinafter referred to as the "Service") provided by GUANG XUN YONG YAO LIMITED. Before accessing, registering for, or using the Service, please carefully read and fully understand the entire content of this Agreement.
By accessing, registering for, subscribing to, or otherwise using RoseProxy, you acknowledge that you have fully read, understood, and agreed to all terms of this Agreement. If you do not agree with any part of this Agreement, please stop using the Service immediately.
RoseProxy: Refers to the network proxy and acceleration technology services provided by GUANG XUN YONG YAO LIMITED (hereinafter referred to as the "Team"), which are designed to optimize network connections and improve access speeds. The Service includes, but is not limited to, the official website, client applications, API interfaces, technical support, and related ancillary services.
User: Refers to any individual, legal entity, or other organization that accesses, registers for, subscribes to, or uses the RoseProxy Service in any manner.
Content: Refers to any text, images, audio-visual materials, data, software, or other forms of information that a User transmits, accesses, stores, or shares through the Service.
Active Subscription: Refers to the status where a User has completed payment according to the Service's prescribed fee schedule and the service is within its valid period.
Account Information: Refers to personal or organizational information provided by a User during registration and use, including but not limited to username, email address, payment information, and identity information.
1. The Service provides network proxy and acceleration functions to help Users improve network connection quality and optimize access speeds.
2. The Service does not guarantee stable access to any specific website, application, or content, nor does it assume any responsibility for the availability, security, legality, or content of third-party websites or services. The User understands and accepts that service performance may vary due to uncontrollable factors such as network environment, regional restrictions, and content provider policies.
3. The Team reserves the right to update, adjust, suspend, or terminate some or all functions or service forms at any time based on market demand, technological developments, or operational strategies, and will notify Users in advance through announcements or other reasonable means.
1. Users must have full capacity for civil conduct. If you are a minor or a person with limited capacity for civil conduct, please use the Service under the guidance and with the consent of your legal guardian. Your guardian shall be responsible for all liabilities arising from your use of the Service.
2. The User warrants that their registration information (including, but not limited to, name, email address, and payment information) is true, accurate, and complete, and is obligated to update this information in a timely manner if it changes. The User shall bear all consequences resulting from providing false information.
1. Upon successful registration, the User will receive a RoseProxy account. The ownership of this account belongs to the Team, and the User only has the right to use the account.
2. The User's account is for personal use only and may not be transferred, lent, gifted, rented, or shared with any third party in any way. The User shall be fully responsible for all activities that occur under their account.
3. The User must properly safeguard their account and password information. The User shall bear all losses resulting from poor safekeeping, such as account theft, password leaks, or unauthorized use of the account. If any unauthorized use or security vulnerability is discovered, the User must notify the Team immediately.
When using the Service, the User must comply with all applicable laws, regulations, and this Agreement. The User must not use the Service to engage in any illegal or improper activities, including but not limited to:
Acts in violation of laws and regulations: Engaging in any activity that violates the laws and regulations of China and the User's location, such as spreading illegal content, organizing gambling, engaging in online fraud, or publishing inflammatory remarks.
Acts that endanger network security: Conducting any form of network attack, scanning, or probing; sending malicious programs, viruses, or Trojans; or engaging in any other activity that compromises network security.
Acts infringing on legitimate rights and interests: Infringing upon the intellectual property rights, privacy rights, portrait rights, reputation rights, or any other legitimate rights and interests of others.
Spamming: Sending a large number of unsolicited emails (spam), advertisements, or other junk information.
Improper use: Using the Service for activities unrelated to its purpose, such as large-scale data crawling, abusing bandwidth, conducting DDoS attacks, or any activity that harms the Service's operation and network stability.
Illegal content access: Using the Service to access, download, disseminate, or store any pornographic, violent, or terrorist content prohibited by law.
Violation of RoseProxy rules: Violating any other reasonable rules or policies of the Service that are published from time to time.
1. If the Team discovers or has reasonable grounds to believe that a User has violated this Agreement or relevant laws and regulations, it has the right to immediately suspend or permanently terminate the service to that User and delete their account without prior notice.
2. The User shall be solely responsible for all compensation if their breach of this Agreement causes losses to the Team or a third party. The Team reserves the right to pursue legal liability.
3. Paid fees: If the Service is suspended or terminated due to a User's breach, any paid service fees will not be refunded.
1. Some functions of the Service are paid items. The specific fees, package types, payment methods, and refund policies are subject to the latest information published on the official RoseProxy website.
2. The User must ensure that their provided payment information is true, legal, and valid. The User shall be responsible for any payment failures or disputes arising from incorrect or illegal payment information.
3. The Service may offer a refund policy, but the specific conditions and procedures for refunds are subject to the refund instructions on the official website. Except where explicitly required by law or expressly promised by the Team, paid service fees will not be refunded.
1. The Team will strictly abide by relevant laws and regulations and take reasonable technical and management measures to protect User data security.
2. To provide and maintain the Service, ensure network security, perform fault diagnosis, and fulfill legal obligations, the Team may record necessary technical information, including but not limited to:
Connection Information: Connection time, duration, and server location.
Bandwidth Usage: Data on the amount of traffic consumed by the User during the connection.
IP Address: The source IP address when the User connects to the Service./p>
3. The Team promises not to actively record, store, or analyze any specific content that a User accesses through the proxy connection (such as Browse history or file content). We are committed to protecting your network privacy.
4. Legal cooperation: The User understands and agrees that if the Team receives a written request from a competent judicial authority in accordance with legal procedures, the Team may lawfully provide necessary technical information or data to assist with the investigation.
1. "As Is" Service: The Service is provided on an "as is" and "as available" basis. The Team makes no express or implied warranties, including but not limited to the continuity, error-free nature, security, or suitability for a particular purpose of the Service.
2. Force Majeure: The Team shall not be liable for service interruptions, data loss, or any other losses caused by force majeure (such as natural disasters, government actions, or war), failures of third-party service providers, failures of network operators, or other factors beyond the Team's reasonable control.
3. Third-Party Risks: Any risks, losses, or liabilities incurred by a User from accessing third-party websites or content through the Service shall be borne by the User alone. The Team makes no guarantees regarding third-party content, advertisements, or services.
4. You shall ensure that any materials submitted to RoseProxy, your use of RoseProxy’s services, and any results arising from the use of RoseProxy’s services do not infringe upon any third party’s lawful rights and interests. You agree that if any claims or demands are made by any third party against RoseProxy or its affiliates due to your own illegal acts, breach of this agreement, or infringement of any rights of others, or if RoseProxy and its affiliates suffer any losses as a result, you agree to fully compensate them. At RoseProxy’s request, you shall defend RoseProxy and hold RoseProxy harmless from the foregoing compensation obligations.
5. During this process, RoseProxy shall promptly provide you with written notice of the third-party claims and offer you reasonable information and assistance necessary for settlement or defense. Any settlement you reach with a third party regarding such claims or demands shall not impose any burden on RoseProxy nor harm RoseProxy’s interests.
Under no circumstances shall RoseProxy be liable for any indirect, incidental, special, or punitive damages or compensation, such as loss of profits, loss of opportunities, loss or damage to reputation/goodwill, or loss of use of data.
Except as otherwise provided in these Terms of Service or as separately agreed between RoseProxy and you for a specific product and/or service, RoseProxy’s liability for damages under this agreement shall in no event exceed 30% of the service fee you paid for the relevant service at the time the damage occurred.
1. RoseProxy and its related trademarks, service marks, website interface, client software, source code, documentation, and all related intellectual property rights belong to the Team and its legitimate rights holders./p>
2. Without the Team's written authorization, the User may not copy, modify, disseminate, sell, rent, or use any part of the Service in any form.
1. The Team has the right to modify the terms of this Agreement at any time based on operational needs, changes in laws and regulations, or business strategies. The modified Agreement will be notified to the User through an announcement on the official website or other reasonable means.
2. If the User does not agree to the modified Agreement, they should immediately stop using the Service. If the User continues to use the Service after the Agreement is modified, it will be deemed that they have read, understood, and accepted all the modified terms.
3. The User may apply to terminate their account at any time through official channels. The Team also has the right to suspend or terminate the Service to a User in accordance with this Agreement if it discovers a violation or in other reasonable circumstances.
1. The conclusion, validity, interpretation, performance, and dispute resolution of this Agreement shall be governed by the laws of the People's Republic of China.
2. Any disputes arising from this Agreement should first be resolved through friendly negotiation. If negotiation fails, either party may file a lawsuit with the competent court in the registration place of RoseProxy.
